Three Steps to Your U.S. Green Card

Step 1. Case Preparation

What is Case Preparation?

It’s the stage where we design the full EB-1 strategy with our U.S. immigration attorney. Together, we choose the right subcategory (EB-1A / EB-1B / EB-1C) and define which evidence best proves your extraordinary ability or leadership.

What documents are needed?

Depending on the category, documents may include awards, publications, membership in associations, recommendation letters, evidence of research or executive experience, corporate charts, financials, and proof of your critical role.

How long does it take?

If your profile is strong, case preparation may take 2–3 months. If your public profile needs strengthening (e.g., publications, memberships, references), it may take 1–6 months longer.

Why is this stage important?

Because USCIS expects a full package — often 1,500–2,000 pages. The way evidence is organized and explained can decide the outcome of your petition.

Step 2. Petition Approval (Form I-140)

What is Form I-140?

The Immigrant Petition for Alien Worker. This is the main petition filed with USCIS to prove that you qualify for EB-1.

Who can file it?

EB-1A: you can self-petition (no job offer required)
EB-1B / EB-1C: must be filed by your U.S. employer

What happens after filing?

USCIS issues a receipt (Form I-797C). Then they either approve, deny, or issue a Request for Evidence (RFE) asking for additional proof.

How long does it take?
Standard processing: ~7–8 months.
Premium processing: 15 days (with $2,805 fee).

Can it be denied?

Yes, but you have options: respond to RFE, refile with stronger evidence, or, in some cases, appeal (Motion to Reopen or Reconsider). Most applicants strengthen and resubmit rather than appeal, as it’s faster and more effective.

Step 3. Green Card Application

After your I-140 petition is approved, the next step is to apply for your Green Card:

- If you are outside the U.S.
You file Form DS-260 and attend an interview at the U.S. Embassy in your country.
- If you are already in the U.S.
You file Form I-485 (Adjustment of Status) without leaving the country.

Processing time: usually 6–12 months, depending on your nationality and the current Visa Bulletin.

Result: You and your family receive U.S. Green Cards — granting permanent residency, freedom to work and study, and a clear pathway to U.S. citizenship after 5 years.
